We understand the importance of, and are committed to, protecting your personal information. This Privacy Policy explains how we manage your personal information (that is, information or an opinion about you, whether true or not, which identifies you or from which your identity is reasonably identifiable), including our obligations and your rights in respect of our dealings with your personal information.

2. The kind of personal information we collect and hold.

We generally will not collect other sensitive information about you such as medical information and records unless it is reasonably necessary for the purpose of providing you with a specific product or service or is otherwise permitted by law.
You can explore our website and search for vehicles without needing to provide any personal information. We only collect your personal details when you fill out and submit a form directly on our site.
Where you do not wish to provide us with your personal information, we may not be able to provide you with requested goods or services.
3. How we collect and hold personal information.
Generally, we collect personal information directly from you where it is reasonably practical to do so, when you contact or deal with us in a fair and lawful manner and not in an intrusive way. We may collect the personal information you directly give us through some of the following means:

(i) purchase a new or used motor vehicle through our purchase contracts;
(ii) lease a vehicle from us through our leasing contracts;
(iii) apply for finance through us;

(vi) submit an application for employment with us;
(vii) make an inquiry, submit a form or order in relation to goods or services through the Website or to us directly;
(viii) contact us via telephone, facsimile, email or other correspondence (whether in writing or electronically); and
(b) in administering and performing any contracts with service providers;
(c) while conducting customer satisfaction and market research surveys;
(d) when administering any of our services; and
(e) as otherwise required to manage our business.
We also collect personal information from third parties, for example from our related entities and dealerships, suppliers, finance or insurance companies providing related services to you. If we collect personal information about you from a third party we will, where appropriate, request that the third party inform you that we are holding such information, how we will use and disclose it, and that you may contact us to gain access to and correct and update the information.
4. Protection of personal information
We protect this information in a number of ways. It is kept in secure locations either in secure physical records, electronically on our intranet system, in cloud storage, and in some cases, records on third party servers, which may be located overseas. Access to the information is restricted to those who have the appropriate authorization under our policies. Where we share the information with third parties we ensure they also have appropriate policies and security in place.
If you provide your credit card or bank account details to us for the purposes of purchasing or leasing a motor vehicle, these details will not be retained by us after completion of the transaction.
When the information is no longer required for a valid purpose or required to be kept by law, it is de-identified, deleted, or securely destroyed.
5. Direct Marketing
Like most businesses, marketing is important to our continued success. We believe we have a unique range of products and services that we provide to customers at a high standard. We therefore like to stay in touch with customers and let them know about new opportunities. We may provide you with information about new products, services and promotions either from us, our related dealerships or from third parties which may be of interest to you.
We will not disclose your personal information to third parties for marketing purposes without your consent.

6. How we use and disclose personal information.
As a general rule, we only process personal information for purposes that would be considered relevant and reasonable in the circumstances.

(a) to enable us to properly respond to your request about purchasing a vehicle, parts, service or repair, finance or insurance;
(b) to provide you with information about products or offers;
(c) to enable us to arrange for you things like vehicle registration, finance or insurance;
(d) to contact you in the event of a vehicle recall or program or any warranty matters;
(e) to maintain records for accounting, administrative and legal requirements;
(f) to provide your details to the vehicle manufacturer for warranty purposes or to conduct customer satisfaction surveys;
(g) for other purposes related to your dealings with us; and
(h) otherwise to manage our business.
We may disclose your personal information to the motor vehicle distributors, manufacturers, financiers or other related suppliers in the provision of supplying our goods and services to you, and they may get in contact with you for purposes that relate to safety, promotional, market research and other matters relating to motor vehicles and you. These parties may disclose your personal information to certain organisations for the purposes outlined above.
You may be asked for consent to appear in our social media publications when you attend one of our events, or when your new vehicle is delivered. If you agree to appear in our social media, photographs or video of you may be placed on our social media feeds. Some of this information may be hosted outside Australia by the social media organisations. If you ask, we will remove material about you from our feeds by deleting the posts, it is possible that the social media organisation or users of the social media platform may have retained copies from the service or re packaged and re posted them. The social media organisations have their own privacy and "take down" policies covering this.
We will not use or disclose your personal information for any other purpose unless you have consented to that use or disclosure.
We may disclose personal information between our organisations or to third parties such as our suppliers, organisations that provide us with technical and support services, or our professional advisors, where permitted by the Privacy Act. If we disclose information to a third party, we generally require that the third party protect your information to the same extent that we do.

A cookie is a small text file stored in your computer’s memory or on your hard disk for a pre-defined period of time. 10. Transfer of personal information overseas.
From time to time, there may be circumstances where we may disclose personal information (including credit information) to overseas recipients in order to provide their products and/ or services and for administrative or other management purposes.
Our business is affiliated with other third party businesses with headquarters and related entities located overseas, such as vehicle manufacturers and original equipment manufacturers or other related suppliers that we use in providing our products and services to you and they may disclose your personal information to their headquarters or related companies located overseas. In the course of doing business with you, we are likely to disclose some of your personal information to overseas recipients. However, we will only do so where:
(a) it is necessary to complete the transaction you have entered into; and
(b) you have provided consent; or
(c) we believe on reasonable grounds that the overseas recipient is required to deal with your personal information by enforceable laws which are similar to the requirements under the APPs; or
(d) it is otherwise permitted by law.
If in future we do propose to disclose personal information overseas, we will do so in compliance with the requirements of the Privacy Act. While it is not practicable to list every country in which such recipients may be located, recipients of such disclosures are likely to include countries where the parent company of our franchisors or distributors exist (including Japan and South Korea, China and USA ), and we will, where practicable, advise you of the countries in which any overseas recipients are likely to be located.
By providing your personal information to us, you consent to us disclosing your personal information to any such overseas recipients for purposes necessary or useful in the course of operating our business and agree that APP 8.1 will not apply to such disclosures. For the avoidance of doubt, in the event that an overseas recipient breaches the Australian Privacy Principles, that entity will not be bound by, and you will not be able seek redress under, the Privacy Act.

11. Automated decision-making processes
As at the date of this Privacy Policy, we may use computer programs to make or do a thing that relates to the making of a decision using your personal information from time to time. This includes the circumstances where we use Google Sheets, random name generators or comment selectors to run competitions and/or customer surveys.
12. Employee information
We collect information in relation to employees as part of their application and onboarding processes and during the course of their relationship with us, either from them or in some cases from third parties such as recruitment agencies. This may include information about the person’s health, their right to work in Australia, or other sensitive information. For some roles, our people may need to undergo vetting, such as background checking or a criminal history search.
We may disclose personal information of our people to third parties in connection with vetting, and otherwise in connection with their relationship with us and their work. These third parties are usually in Australia. When disclosing our people’s information we ensure that the recipient is bound by an obligation of confidentiality, where it is lawful and appropriate to do so.
Under the Privacy Act, personal information about a current or former employee may be held, used or disclosed in any way that is directly connected to the employment relationship. We handle employee information in accordance with legal requirements and our applicable policies in force from time to time.
